WELCOME TO SIMPLY DANCING & ART

We want every family to understand how our program works before signing. This Agreement explains training, tuition, private lessons, competitions, travel, safety expectations, family responsibilities, and cancellation rights in clear language. Some sections at the end are more formal because Florida law requires specific wording for dance-studio contracts and minor-participant waivers.

This Agreement is between SIMPLY DANCING ART, INC., a Florida corporation doing business as Simply Dancing & Art ("SDA" or the "Studio"), and the parent or natural/legal guardian signing below ("Parent"), on behalf of the minor student ("Student").

1. Enrollment, Family Information & Communication

1. Parent authority. The Parent confirms authority to enroll the Student, make training decisions, and accept financial responsibility for the Family Account.

2. Agreement term. This Agreement runs for twelve months unless it ends earlier under the withdrawal, statutory cancellation, or Studio-termination provisions. Routine changes to schedule, level, instructor, tuition, or private-lesson rate do not by themselves require a new legal Agreement.

3. Information and custody. The Parent will keep contact, billing, safety, emergency, and competition information current and will provide any court order or legal restriction affecting pickup, access, or communication.

4. Emergency contact and pickup. An emergency contact is not automatically authorized to pick up the Student. Alternate pickup requires advance Parent notice.

2. Tuition, Billing & Family Account

5. Monthly tuition. Monthly tuition is annualized and divided into regular monthly installments. It does not vary with the exact number of classes in a month. Absences, vacations, school activities, competitions, holidays, planned Studio breaks, instructor travel, and special SDA events do not reduce monthly tuition.

6. Payment deadline. Monthly tuition must be received by the third calendar day of each month. Tuition received after the third is subject to a $50 late fee.

7. Payments. A payment is received when cleared funds are received. Declined, returned, reversed, or charged-back payments do not satisfy the underlying charge.

8. Payment application. When the Parent identifies what a payment is for, SDA will apply it that way when reasonably possible. Without a designation, SDA may apply payment to the oldest outstanding eligible charge.

9. Family Account credit. Credit may be used for eligible charges for any child in the Family Account. Ordinary Family Account credit does not expire merely because a Student withdraws.

10. No ordinary proration. Monthly tuition is not prorated or refunded for ordinary absences, vacations, school events, competitions, or voluntary reduction in attendance. Florida statutory rights remain unaffected.

11. Sibling pricing. Family pricing is by individual SDA agreement and is not automatic.

12. Fees. Initial registration is $25. Re-enrollment after a completed withdrawal is $25. These fees are non-refundable except where law requires otherwise.

14. Thirty-day withdrawal. A Parent may withdraw the Student by giving thirty calendar days' written notice by email, Parent Portal, or text/WhatsApp to the official SDA contact. Oral notice and simply stopping attendance are not sufficient.

17. Past-due accounts. At $2,500 past due, SDA may review the account and may limit additional services until the balance is addressed or an approved plan is in place.

3. Private Lessons

20. Separate billing. Private lessons are always separate from monthly tuition. A standard SDA private lesson is forty-five minutes.

21. Cancellation and lateness. At least twenty-four hours' notice allows cancellation/rescheduling without charge. Late cancellation or no-show may be charged in full.

23. Packages. Private packages are non-refundable, normally non-transferable, and expire six months after purchase.

4. Group Classes, Ballet, Schedule & Placement

26. Make-up classes. A missed group/ballet class does not automatically create a refund, credit, or make-up. SDA may approve a make-up for illness with a medical note when a suitable class is available.

29. Placement and attendance. SDA determines level/program based on age, experience, technique, attendance, readiness, goals, maturity, and ability to follow instruction. Advancement is not automatic by time enrolled.

5. Competitions & Partnerships

31. Participation and results. SDA determines readiness, dances, categories, entries, partnerships, and events. SDA does not guarantee placements, medals, rankings, scholarships, advancement, qualification, or a specific partner.

32. Commitment. Participation becomes financially committed when the Parent confirms in writing and SDA makes or confirms entries/bookings. Unrecoverable committed costs remain due after withdrawal.

6. Instructor & Coach Travel

37–43. For competitions outside South Florida, participating students share reasonable instructor/coach travel expenses equally. Travel is divided among students (not families). Two siblings count as two participants. SDA may collect an estimated share; if actual costs are materially lower, the difference becomes Account Credit.

7. Guest Coaches, Camps, Special Events & Training Materials

46. Camps and events. After registration/payment, these are non-refundable unless event-specific terms or law provide otherwise.

8. Studio Environment, Parent Conduct & Student Behavior

48–57. Parents may observe but may not coach from the sidelines or interrupt active instruction. Students must follow instructor directions and respect others. Aggressive or threatening parent conduct is prohibited. The default is NO independent departure for minors.

9. Health, Safety & Emergencies

58–61. Do not bring a Student with fever, vomiting, or obvious contagious illness. SDA may call 911 in an emergency. Dance involves inherent physical risks addressed in the separate Minor Participant Waiver below.

10. Media, Privacy, Property & Accommodations

62–64. Photo and video consent. Media consent is selected separately as APPROVED, DECLINED, or LIMITED. If approved, SDA may use the Student's name, image, and likeness for promotional material without compensation. Declining consent does not affect training.

11. Ending Enrollment by SDA; Studio Closure

70. Termination by SDA. If SDA terminates enrollment, no future tuition is charged after the effective date. Prepaid regular tuition for future services not provided is refunded or credited.

12. Florida Dance Studio Act — Customer Cancellation Rights

72. Three-day cancellation right. The Parent may cancel this Agreement without penalty within three days after signing it, excluding weekends and holidays, by mailing or delivering written notice of cancellation to SDA.

73. Cancellation for death, disability, or cessation of services. After the three-day period, additional statutory cancellation rights may apply if the Student or Parent dies, becomes physically or mentally unable to use the services, or if the services cease to be offered.

13. General Legal Provisions

80. Good-faith resolution of disputes. Before filing a lawsuit, each party should give the other written notice and a thirty-day opportunity to resolve it.

81. Governing law and venue. Florida law governs this Agreement. Any court proceeding will be brought in Broward County, Florida.

83. Electronic signatures. This Agreement may be signed electronically to the extent permitted by Florida law. SDA preserves signed versions with signer identity, date and time, and media election.

Minor Participant Waiver and Release

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY.

YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY.

YOU ARE AGREEING THAT, EVEN IF SIMPLY DANCING ART, INC. USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED.

BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM SIMPLY DANCING ART, INC. IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY.

YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND SIMPLY DANCING ART, INC. HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

Inherent risks include falls, collisions, partner contact, strains, sprains, fractures, bruising, overexertion, cardiovascular events, injuries involving floors, equipment, footwear or costumes, travel-related risks, and actions of other participants.

Release. To the extent permitted by section 744.301(3), Florida Statutes, the Parent, as natural guardian, waives and releases claims that would accrue to the Student against SIMPLY DANCING ART, INC. and its owners, affiliates, employees, and agents for personal injury, death, or property damage resulting from an inherent risk in the Activity. This release waives no more than Florida law permits.

Parent's own claims. On the Parent's own behalf, and to the fullest extent Florida law permits, the Parent releases claims arising from the Student's participation, including claims associated with ordinary negligence. This does not extend to gross negligence, intentional misconduct, or liability that Florida law does not permit a party to release.

Assumption of risk. The Parent voluntarily accepts the inherent risks of the Activity on the Parent's own behalf and on behalf of the Student.

Fitness to participate. The Parent confirms that, to the Parent's knowledge, the Student is fit to participate and that any condition materially affecting safe participation has been disclosed to SDA in writing.

Governing law. Florida law governs this Waiver. Agreement version: SDA-2026-09.

By submitting, your registration goes to the studio for review. Portal access is activated after approval.
